9th Circuit: School Can Ban U.S. Flags

A Northern California high school's order for students to turn their U.S. flag T-shirts inside out during a Cinco de Mayo celebration was legal, the 9th U.S. Circuit Court of Appeals ruled Thursday. The court said that concerns over racial violence outweighed students' freedom of speech rights. School officials feared the American flag attire would anger Latino students celebrating the Hispanic holiday. "Our role is not to second-guess the decision to have a Cinco de Mayo celebration or the precautions put in place to avoid violence," Judge M. Margaret McKeown wrote for the court. Past incidents "made it reasonable for school officials to proceed as though the threat of a potentially violent disturbance was real."
